1. Summary

Stampup supplies digital loyalty cards which a customer stores in the wallet application of a mobile telephone, together with a portal in which the business issuing those cards designs and operates its loyalty programme. These terms govern the stampup website, that portal and every stampup loyalty card, and they apply to any person who visits the website, operates the portal or holds a card. This section summarises them for ease of reading, and the sections which follow contain the terms themselves and prevail over anything stated in this summary.

A Card is issued and held free of charge, and the Merchant whose Card is held determines the number of stamps which earns a reward, the nature of that reward and the occasions on which a stamp is awarded. Promotional communications depend on a separate consent given on the sign-up form, and that consent may be withdrawn at any time by a single tap. Cards are available to persons aged sixteen years and over. A Merchant operating a Programme on stampup accepts in addition the merchant terms presented to it when it registers, which carry the plans, the prices and the data-processing agreement. These terms are governed by the law of the Netherlands, and a Card Holder who holds a Card as a consumer retains the mandatory protections conferred by the law of the country in which that Card Holder resides.

2. The provider and the terms defined

2.1 Stampup supplies loyalty cards to small businesses. A business issues a card, the customer adds that card to the wallet application of a mobile telephone, and the card records the stamps awarded to that customer at the counter. The provider of the Services is identified as follows.

Name:
Stampup VOF
Registered address:
Vivaldilaan 95, 3122 HW Schiedam, the Netherlands
Company number:
42187962 (Kamer van Koophandel)

2.2 In these terms the following expressions carry the following meanings. The Services means the Site, the Portal, the Cards and the messaging and wallet functionality associated with them, taken together. The Site means the public stampup website. The Portal means the application in which a Merchant designs a Card, awards stamps and reads the figures for its business. The Card means a stampup loyalty card, the Card Holder means the individual in whose name a Card is issued, and the Merchant means the business which operates a Programme on stampup. The Programme means the loyalty scheme operated by a Merchant, comprising its stamps, its rewards and the occasions on which each is given. The Wallet means Apple Wallet, Google Wallet or any comparable application in which a Card is stored.

2.3 Use of the Site, of the Portal or of a Card constitutes acceptance of these terms in the version published at the time of that use. Any question concerning their meaning may be put to stampup by electronic mail at the address given in section 14, and stampup answers it.

3. The Site

3.1 The Site describes what the Services do and what they cost, and it is published in order to be read, shared and linked to. Nothing on it forms an offer capable of acceptance in itself, and a subscription arises only when a Merchant registers in the Portal.

3.2 The prices and the features shown on the Site describe the Services as they stand on the date of publication, and both develop as the product develops. The price payable by a Merchant remains the price which that Merchant agreed when it registered, until notice of a change is given to it in accordance with the merchant terms.

3.3 The Site is made available on condition that its contents are used without extraction for the purpose of a competing service, without any attempt to obtain unauthorised access to it, and without the imposition of any load intended or likely to impair its operation. Stampup reserves every remedy available to it in respect of conduct of that kind.

4. The Portal

4.1 The Portal is the application in which a Merchant designs its Card, awards stamps to its customers and reads the figures for its Programme. A Merchant uses the Portal under a separate commercial agreement, which is presented to it and accepted by it when the account is created, and which carries the plans, the prices and the data-processing agreement applicable to that Merchant.

4.2 An account in the Portal belongs to the business which opened it. The password and the counter pin for that account are confined to the persons who require them, and stampup is to be informed on the day on which the Merchant suspects that another person has obtained either of them.

4.3 The Merchant is responsible for everything done from its account, including everything done by its staff at the counter, and stampup is entitled to treat an instruction given from that account as an instruction of the Merchant itself.

5. The obligations accepted by every Merchant

5.1 Six rules bind every Merchant which operates a Programme on stampup. They are reproduced on this public page so that the persons who carry the Cards are able to read the obligations which the Merchant has accepted, and they appear in the same form in the merchant terms.

5.2 The customer list of a Merchant exists so that the Merchant may serve the people who joined its Card, because those people joined that particular shop, and the Merchant uses that list for its own shop alone. Selling the list, renting it, exchanging it or handing it to another business is a breach which brings the account of the Merchant to an end.

5.3 A Merchant sends promotional messages only to the members who have ticked the box consenting to them, and every other member receives the messages which the operation of the Card itself requires and nothing further. Health, money, politics and sex remain outside this channel, and the subject of a message is the shop of the Merchant, its offers and its rewards.

5.4 A stamp stands for a visit or a purchase which the customer has actually made. Awarding stamps in bulk, and awarding stamps to oneself, are inconsistent with that principle and are accordingly prohibited.

5.5 Health practices sit outside stampup for the present. Clinics, physiotherapy practices, fertility services, mental-health practices and other health practices wait until the additional protections which their data requires are in place. Beauty salons, barbers, hairdressers, nail studios, gyms and comparable businesses are welcome on the Services today.

5.6 A Card Holder who considers that a Merchant has departed from any of these rules may write to stampup at hello@stampup.app, setting out what occurred, and stampup investigates the matter.

6. Card Holders

6.1 A Card is free of charge, and stampup makes no charge to a Card Holder either for holding a Card or for using one. The Programme behind the Card belongs to the Merchant, which decides how many stamps earn a reward, what that reward is, what a stamp is worth and when the Programme changes.

6.2 A Merchant may remove a stamp which it believes was never earned. A Card Holder who considers that a stamp ought to have remained takes the matter up with the Merchant which removed it, since the Programme and the record of the visit behind it belong to that Merchant.

6.3 Cards are available to persons aged sixteen years and over. The card code and the login code issued to a Card Holder are kept confidential by that Card Holder, because those codes open the stamps recorded on the Card and a person who holds them holds the Card itself.

6.4 Stampup may bring a Card to an end where the Card is used for fraud or for abuse, and it tells the Card Holder when it does so and states its reasons. The deletion of the personal details of a Card Holder brings that Card to an end as well, and the privacy policy explains how deletion is requested.

6.5 A reward which has been earned comes from the Merchant and is obtained at the counter of that Merchant. Where a Merchant closes or leaves stampup, the Programme leaves with it, and the stamps gathered under that Programme cease to count towards a reward.

7. Promotional communications

7.1 The sign-up form carries a second tick, distinct from the tick by which these terms are accepted. It is presented empty, and a Card Holder who leaves it empty holds a Card which works in exactly the same way. It reads as follows:

Send me offers from shops that use stampup

7.2 A Card Holder who gives that consent receives offers from the Merchant whose Card is held and from other businesses which use stampup, delivered by wallet pass notification, by electronic mail or by text message.

7.3 The consent may be withdrawn at any time, either through the unsubscribe link carried on the Card or by electronic mail to privacy@stampup.app. Withdrawal stops the offers and leaves the stamps and the rewards of the Card Holder exactly where they stand.

7.4 Notifications which tell a Card Holder that a stamp has landed and that a reward has become available form part of the ordinary operation of the Card and continue irrespective of that consent. The privacy policy describes how messages work, including the quiet hours observed and the limits on how often a message arrives.

8. Ownership and intellectual property

8.1 Stampup owns the software, the Site, the designs and the stampup name, together with the intellectual property rights subsisting in each of them. Use of the Services confers on the user the right to use them while these terms hold, and leaves that ownership exactly where it stood.

8.2 The logo, the artwork, the photographs and the words uploaded by a Merchant remain the property of that Merchant. By uploading them the Merchant grants stampup the licence required to display them on its Cards, on its sign-up page and within the application, which is the purpose for which they are uploaded. The Merchant is responsible for holding the rights necessary to use the material which it uploads.

8.3 Stampup may act freely on any suggestion for the improvement of the Services which is sent to it, and a suggestion sent in that way carries no obligation on stampup unless the parties agree otherwise in writing.

9. Availability of the Services

9.1 Stampup works to keep the Services available and quick. Maintenance, updates and the occasional fault nevertheless interrupt them, and stampup keeps interruptions of that kind short.

9.2 The counter confirms a stamp from the stampup database at the moment the stamp is awarded, so that the stamp counts immediately. The Card held in the Wallet follows a short time afterwards, because Apple and Google deliver those updates on their own schedule.

9.3 Apple Wallet, Google Wallet, the telephone networks and the electronic mail providers lie beyond the control of stampup. The Services are built around the limits which those parties impose, and their outages are borne accordingly.

9.4 Features arrive, change and retire as the product develops, and stampup gives a Merchant notice before removing a feature on which that Merchant relies.

10. Limitation of liability

10.1 The Services are supplied as they stand. To the fullest extent permitted by law, stampup excludes its liability for any loss arising out of the Services, the Site, a Card, a message or anything which a Merchant does in the conduct of its Programme.

10.2 One exception survives that exclusion: loss caused by the intent or the deliberate recklessness of stampup itself. The law of the Netherlands refuses to permit the exclusion of liability of that kind by contract, and stampup makes no attempt to exclude it.

10.3 A Card Holder who holds a Card as a consumer retains the protections conferred by the law of the country in which that Card Holder resides, and nothing in these terms operates to take them away.

10.4 The Programme behind a Card belongs to the Merchant. A question concerning a reward, a stamp or an offer is addressed in the first instance to that Merchant, and stampup assists where it is able to do so.

11. Termination

11.1 A Card Holder may leave the Programme of a Merchant at any time, either by removing the Card from the Wallet or by asking stampup to delete their personal details, which brings the Card to an end as well.

11.2 Stampup may bring a Card or an account to an end where it is used for fraud, for abuse or in a manner which breaches these terms. In the case of a Merchant, the merchant terms describe the written warning and the time to remedy which precede any step of that kind.

11.3 Where a Merchant leaves stampup, the Cards issued under its Programme cease to operate at the end of the period for which that Merchant has paid, and the customer details held for it are deleted ninety days afterwards.

12. Amendments to these terms

12.1 This page carries a version and a date at its head. The version published here is version 2026-09-16, in effect from 16 September 2026.

12.2 A Merchant receives thirty days of notice by electronic mail before a new version applies to it, and use of the Services after that date constitutes acceptance of the new version. A Merchant which would rather stop may cancel before that date at no cost.

12.3 For Card Holders, a new version is published on this page together with the date from which it takes effect, and acceptance is requested again the next time that a Card Holder joins a Card or changes their personal details.

13. Governing law and jurisdiction

13.1 These terms are governed by the law of the Netherlands, and a dispute arising out of them is submitted to the competent court in the Netherlands.

13.2 A Card Holder who holds a Card as a consumer retains the mandatory consumer protections of the country in which that Card Holder resides, including the right to bring proceedings wherever the rules of that country so allow.
